With all of the recent storms in Ohio I am often asked about damage to homes due to trees falling or large limbs hitting homes or autos.
My answer is usually "it's complicated."
If your neighbor's tree falls on your house or car, who pays? Depends. If the owner knew the tree was dead and did nothing, then they would likely be responsible. If the tree was live and hit your house then your insurance would handle it. They may elect to recover from the owner's company.
If your tree is partially uprooted but no damage was caused your company will probably not cover it. Get it taken care of immediately to avoid loss or injury.
If your tree hits your car? Not generally a homeowner's policy issue. File a claim under your auto policy for your comprehensive coverage.
As always, consult your agent. They live where you live. The 800#'s can be talking to you from anywhere in the world and the answers may not always be consistent or accurate..

Water, water everywhere and .............................
If this is happening to you make sure you know if you are insured properly. Water - Sewer back-up protection is available to handle that type of situation. This can affect your furnace or a finished basement.
If an area is flooded due to rains and the storms we have experienced you would need to make sure you have flood insurance. This is a federal government (FEMA) policy and can be purchased through your agent. They are all the same and based upon your location and valuation.
Call your agent or the 1-800 number you purchased your insurance through to be sure you are covered.

Welcome to spring on Ohio's roads! The blacktop is breaking up and getting thrown into our windshields. If this happens to you and the damage is only about the size of a half dollar then it can be repaired. Maybe not if it is in your line of sight but the glass companies do great work fixing these chips. And there is usually no cost to you if you have 'comprehensive' coverage. If the crack is larger the windshield should be replaced. This will mean using your comprehensive deductible first then the insurance company pays the rest. It does not count as a claim on your policy. If you need our services we work with a few excellent vendors that will come to you to make the neecessary repairs. ICE DAMS

Ice damming and water leaking into homes is becoming a problem again this winter. Snow and ice build up on our roofs has brought in damage to ceilings and walls. Here are some tips to help.

What is ice damming?
Ice and snow build-up on a roof is an unprepared homeowner's nightmare when heat from a roof covered with at least eight inches of snow melts, leaving the remaining liquid to seep into shingles and tiles. Ice dams can be lumps of ice that form on gutters, eaves and valleys, and prevent melting snow from running down. As the snow melts, the water backs up and seeps under shingles or tiles and eventually into your home.

Preventing ice dams can be as simple as mounting proper insulation and avoiding improper removal of ice and snow. Take a look at these other tips to help minimize ice dam formation on your roof and protect your home from winter damage:
~ Keep gutters and downspout clear of leaves and natural debris;
~ Identify areas of heat loss in your attic and properly insulate them to prevent heat from escaping;
~ Minimize heat loss through the attic by wrapping or insulating all heating ductwork;
~ Avoid using sharp tools or ice picks on gutters or downspouts, which can damage roofs. Use a snow rake or soft broom to clear fresh snowfall from gutters;
~ Contact a professional snow removal company to clear existing ice dams; and
Protect yourself by avoiding falling icicles or avalanching snow. Avoid getting on the roof and working on a ladder or beneath a roof that has accumulated large amount of snow.

New Years Day alert

While Americans are enjoying the holidays and most have time off from work, holidays are just another day at the shop for vehicle thieves. Please make sure your car is secure if you go out on New Years.

New Years Day led all holidays with the most car thefts. (Unless some people just forgot where they parked their car the night before!)
Christmas day had the least thefts. (Nice of some thieves to take Christmas day off!)
And the second most active holiday for vehicle thieves.....Halloween. (Their kids are cleaning out your candy bowl while the adults are leaving with your car!)

If there is good news, Holiday car thefts are trending down. For the 11 holidays reviewed in 2009, a total of 22,991 vehicles were reported stolen compared to a total of 24,676 reported for those same days in 2008, according to an analysis by the National Insurance Crime Bureau (NICB).

From the Ohio Department of Insurance. In the wake of a damaging storm, such as a hail storm or tornado, home repair contractors often go door to door to offer roofing, siding and repair services. While a majority of the contractors are reputable, there are unscrupulous home repair contractors who prey on consumers who are anxious to get their property and lives back in order.

To avoid being victimized:

Immediately contact your insurance carrier if you believe you have damage

Request a list of reputable contractors from your carrier or the BBB

Contact multiple contractors to get more than one estimate

Do not give them Power of Attorney or allow them to settle your insurance claim

Do not pay in full until all work is done.

Do NOT pay in cash. Use credit card if possible

Call your insurance agent if you have questions about your claim. Do not rely on the contractor for information.

We at The Butler Agency are proud to support the American Cancer Society through the Relay for Life walking marathon. This is such a great event and very well run. We have donated money and for the second year will be spending the 18 hours between 6pm on Friday the 25th and noon Saturday relay walking around the track at Westerville Central High School.

If only we provided blister insurance. Shin splint insurance. Sleep deprivation coverage. Walking shoe blow out insurance.

I guess if it gets bad enough I can use our Accident insurance, wellness protection, disability coverage......................

The Columbus City Code Texting Ban became effective on May 5, 2010. It is a primary offense for which you may be stopped if there is reasonable suspicion that you are violating the statute. Once a driver is stopped, or has been involved in an accident, an investigation may take place to determine whether or not there is probable cause to believe that the driver was in fact violating the texting ban. Those caught texting behind the wheel will face a $150 fine. Unlike seat-belt enforcement, you can be stopped and ticketed just for texting. The ban covers writing and reading text messages OR E-MAIL, as well we using the INTERNET while driving. It covers only drivers, not passengers. You're considered to be driving even if you're stopped at a red light or stuck in traffic. You must be parked or pulled over to text legally from your car. How will they prove it? It appears the "investigation" authorized by the statute includes the right to seize your phone and obtain a search warrant. Otherwise, they do not have a right to search your phone, unless you consent and allow them to do it. It will be interesting to see if the police dare infringe upon the 4th Amendment and begin seizing cell phones. Doubtful, since that will require a lot of time and money for such a small offense. Moreover, Columbus police concede that, "short of an all out admission, spotting a violator will be difficult" (So don't admit to anything and don't let them search your phone!). Remember, if the officer's testimony is going to be, "it looked like texting", well that doesn't equate to 'proof beyond a reasonable doubt'. In addition, the city code is in violation of state law since the state requires all traffic codes to be uniform throughout the state and all municipalities. However, it is likely only a manner of time before there is a state-wide ban.
